Sanctions schedule

Offences, responsible participants and fixed-payment notice amounts under Irish ADR regulations.

Version and scope

Checked 18 October 2026. This editorial guide covers road carriage of dangerous goods in the Republic of Ireland under S.I. 349/2011 as amended through S.I. 249/2026 and S.I. 415/2026. The official legislation is in English; Spanish and Portuguese are editorial translations.

The current fixed-payment schedule contains 56 offence entries. S.I. 249/2026 updated the wording of offences 5, 6, 13 and 52; those updated descriptions are used below. S.I. 415/2026 added market-surveillance enforcement provisions for transportable pressure equipment.

How fixed-payment notices work

A fixed-payment notice is an optional alternative an inspector may offer for a listed offence. Payment may be made within 21 days. It is not an automatic fine. The participant is not obliged to pay; if the notice is paid in time, no prosecution for that alleged offence will be started.

The category shown in each row is the highest risk category that may be assigned in Schedule 2, Part 3. The inspector determines the category where the schedule allows discretion, considering the particular circumstances. The amounts below are therefore the maximum fixed payment for the listed category: Category I €500, II €250, III €100.

Category I — up to €500Category II — up to €250Category III — up to €100

Each row links to the principal instrument. The offence number is the reference in Schedule 2, Parts 1 and 3; S.I. 249/2026 separately amends the offence-summary text for numbers 5, 6, 13 and 52.

Other offences prosecuted in court

The 56-entry fixed-payment table is not an exhaustive list of every offence. Regulation 26 also makes it an offence, among other things, to breach ADR or Regulations 8–9, contravene a prohibition or contravention notice, forge or alter relevant documents, interfere with transport equipment or safety labels, obstruct or impede an inspector or customs officer, refuse an inspector’s lawful request, give material false or misleading information, falsely claim to be an inspector, or tamper with an official notice. It also covers non-compliance with duties in Parts 8 and 9.

Obstruction and these other non-listed offences are not assigned one of the €100/€250/€500 fixed-payment amounts by this schedule. They may instead be prosecuted under Regulation 27, subject to the distinct rule for Regulation 26(14). See Regulations 26–27.

Court penalties and transportable pressure equipment

For offences under Regulation 26, Regulation 27 provides, on summary conviction, a Class A fine (currently up to €5,000 under the Fines Act 2010), imprisonment for up to 12 months, or both. On conviction on indictment, the maximum is a €500,000 fine, imprisonment for up to 3 years, or both. For the specific offence in Regulation 26(14) (failure to comply with an information notice under Regulation 21), the stated liability is a Class A fine on summary conviction. These are court penalties, separate from the optional fixed-payment notice.

S.I. 415/2026 extends market-surveillance powers and enforcement for transportable pressure equipment in Part 9. On conviction for a Part 9 offence, a court may order forfeiture of the equipment or another relevant thing for destruction or disposal, and may order payment of destruction or disposal costs. New Regulation 80 also allows recovery from the economic operator of reasonable costs of measures concerning non-compliant equipment, including testing, intervention and storage. These are potential additional consequences, not fixed-payment amounts.

The legislation also allows a court, in specified prosecutions, to award investigation and prosecution costs. The amount is assessed by the court; no general euro tariff is set here.

The table follows the enacted text and amendments. The HSA consolidation is an administrative aid, not a legal instrument; it is updated only to 2025, so the 2026 instruments are linked separately.
